- "User" or "Users" denotes any individual or entity that accesses, views, registers, or interacts with the Courses, content, services, or features offered on the Platform, regardless of whether they have created an account or made payments.
- "Courses" are comprehensive language learning programs available in free and paid formats, incorporating various multimedia resources to enhance language proficiency.
3. General Requirements
Unless explicitly stated otherwise in these Terms and Conditions, the following terms shall have the meanings ascribed to them:3.1. The Platform's primary purpose is to provide Users with access to language learning Courses utilizing multimedia resources.
3.2. By using the Platform, you agree to abide by these Terms and Conditions, including any amendments that We may introduce from time to time.
3.3. We reserve the right to modify, suspend, or terminate the Platform, Courses, or any services on the Platform at our sole discretion, with or without notice. Such actions may include the suspension or termination of User accounts.
3.4. Users must register an account on the Platform to access paid Courses. We reserve the right to refuse access or account registration for any reason.
3.5. Users represent and warrant that they possess the legal capacity to enter into agreements and, if minors, have obtained consent from their legal representatives to use the Platform. Failure to obtain such consent may result in account suspension or termination.
3.6. Users further represent that the information provided during registration is accurate, legitimate, unaltered, and up-to-date. Providing false or inaccurate information may result in account suspension or termination.
3.7. Users may register via third-party services (e.g., Google). We are not responsible for third-party services, their functionality, or privacy policies.
4. Data Privacy

5. Intellectual Property
5.1. Platform Ownership: We are the sole owner of all Intellectual Property on the Platform, including Courses. Users agree not to violate our Intellectual Property rights and not to challenge our ownership.5.2. Reservation of Intellectual Property: We retain all Intellectual Property rights on the Platform and Courses. Users may not use Intellectual Property without our prior written consent.
5.3. Limitation on the use of the Platform: By accessing and using Courses, Users are granted a limited, non-exclusive, non-transferable right for personal, non-commercial use. Any other use, including copying, reproducing, modifying, or distributing, is not permitted and may result in legal action.
6. Users' Accounts
6.1. Users are allowed to register for only one User account. In the event that the Siteidentifies multiple User accounts belonging to a single User, the Site reserves the right to suspend the User account. Such suspension may result in the loss of privileges, including coupons, discounts, gift vouchers, and any other benefits previously granted or used by the User (if any).6.2. The User assumes full responsibility for all actions carried out under their User account, regardless of their intention.
6.3. The User agrees to maintain the confidentiality of their password. The Site is not liable for any loss or damage arising from the User's failure to protect this information, any data breaches, or unauthorized access to the User account by third parties.
6.4. The Site reserves the right to cancel a User account, remove or delete any content or information associated with User accounts on the Platform, and restrict or deny access to the Platform or other services in the following scenarios:
(a) If the User account remains inactive for an extended period, and the Site deems it appropriate to delete the User account.
(b) If the User breaches these Terms and Conditions.
(c) If the User engages in actions that may violate the law.
(d) If the User uses the Platform in a manner that may harm other Users, third parties, or the business interests of the Site.
7. Terms of Use of the Platform
7.1. Users agree to use the Platform exclusively for lawful purposes and by legal means.7.2. Users assert that any content or information, including documents, provided or displayed on the Platform, is accurate, current, and in compliance with applicable laws. If the provided content or information is found to be inaccurate or unlawful, Users accept full responsibility and commit to compensating the Site for any resulting damages suffered by the Site, other Users, or third parties.
7.3. Users are prohibited from:
(a) Uploading, posting, transmitting, or commenting on any content or information that could be considered a violation of laws, statutes, or international regulations. Users must not impersonate other individuals or entities, make false statements about any person or entity, engage in fraudulent, unethical, or misleading activities.
(b) Using the Platform for the benefit of third parties or in any way that contravenes the Terms and Conditions.
(c) Creating or using multiple User accounts for activities that violate the Terms and Conditions or the purpose of the Platform.
(d) Uploading, posting, emailing, transmitting, or sharing any content or information that contains viruses, computer code, files, or programs designed to damage or disrupt the Platform's functionality, computer software, hardware, data, or equipment.
(e) Violating the terms and conditions of networks connected to the Platform by disrupting, modifying, or interfering with the Platform, a server, or a network connected to the Platform, or the Platform's usability by other Users.
(f) Participating in or facilitating actions that may directly or indirectly damage or disrupt the Platform, the server, or anetwork connected to the Platform.
(g) Uploading, posting, transmitting, or sharing any content or information that infringes upon copyrights, trademarks, patents, trade secrets, or the Intellectual Property rights of others, or using the Platform in a manner that infringes upon the Intellectual Property of others.
7.4. Users acknowledge and agree that all content or information, whether publicly posted or privately shared, is solely their responsibility. The Site is not liable for any content or information Users upload, post, email, transmit, or use on the Platform. The Site makes no representations or warranties regarding the accuracy, completeness, or correctness of such content or information. The Site is not liable for any content or information, including errors, omissions, or any loss or damage incurred due to the use of such content or information on the Platform.
7.5. Users acknowledge and agree that the Site has the right, at its sole discretion, to review, reject, delete, or move any content or information on the Platform without prior notice, including content or information that:
(a) Violates the Terms and Conditions.
(b) Receives complaints from other Users.
(c) Is the subject of an Intellectual Property infringement complaint or has been ordered to be removed by a competent authority. In this regard, the Site may suspend communication on the Platform, including the suspension of status updates, posted messages, and discussions, as part of its efforts to protect the Platform and its Users. Users understand and agree to assume all risks associated with using content or information, including its accuracy, completeness, or usefulness.
7.6. Users acknowledge and agree that the Site has the right to access, retain, and disclose User account information and related content as required by law, court orders, or competent authorities. This access may be for purposes of compliance with legal procedures, enforcement of the Terms and Conditions, responding to claims of content infringement by third parties, responding to User requests, or protecting the Site's proprietary rights or the safety of the Site, Users, and third parties.
7.7. Users are prohibited from using payment methods other than those provided on the Platform.
7.8. The Site reserves the right to delay or suspend any transaction for the purpose of fraud detection, protecting the Site, preventing illegal activities, and ensuring compliance with the Terms and Conditions.
7.9 In the case that Users are under the administration of an Admin-type User (such as a school or an employer user account), (“Admin User”), Users acknowledge that to ensure compliance with the Terms and Conditions, the Admin User will have access to Users' data and account usage details. The Admin User agrees to manage such data in accordance with our Privacy Policy, with a specific emphasis on maintaining its confidentiality and using it exclusively for the purposes of administering and monitoring the usage of the Platform.
7.10 Users agree to maintain the confidentiality of their passwords and other security-related account information and to safeguard their accounts against unauthorized or fraudulent use.
8. Violation of Terms and Conditions
8.1. In the event of a violation of the Terms and Conditions, the Site reserves the right to take any or all of the following actions at its sole discretion:(a) Promptly remove Courses, content, or information from the Platform.
(b) Delete all or part of the saved Courses, content, or information.
(c) Suspend or permanently terminate the User account.
(d) Prohibit the User from accessing the Platform or Courses, or restrict the use of the services on the Platform for a specified period.
(e) Cancel, suspend, or limit privileges, such as coupons, discounts, gift vouchers, or any other privileges granted or used by the User (if any).
(f) Pursue civil or criminal legal actions, including claims for damages and/or temporary injunctions, before or after a court judgment or order.
9. Courses Purchase and Payment
9.1. Users can browse the catalog of available Courses on the Platform and select their desired Course(s) for purchase.9.2. To purchase Courses, Users must use the payment method specified on the Platform. Users can change the payment method before completing the payment. If the User fails to make payment in accordance with the terms and conditions, or if the payment is canceled, the Courses purchase order will be considered incomplete. In such cases, the User is solely liable for any resulting damages.
9.3. In addition to one-time Course purchases, we offer subscription packages for Courses, including monthly and annual packages designed for continuous access to Courses. Please note that subscription fees are non-refundable, and Users are encouraged to review the terms of the selected subscription package before committing to it. We may also provide notifications before the subscription package expires. All times mentioned in this clause will be based on Bangkok, Thailand GMT+7 time.
9.4. All payments for access to paid Courses on the Platform are non-refundable, without exceptions. Once a payment is processed, no refunds or reimbursements will be provided. Users are advised to review Course details, pricing, and any trial options before making payments, as our no-refund policy is strictly enforced. By making a payment for a Course, Users acknowledge and agree to this refund policy.
9.5. Upon payment confirmation, Users will gain immediate access to the purchased Course(s) on the Site. Course materials, resources, and associated content will be accessible in the User's account for the specified duration of each Course. For live courses conducted via the Zoom platform (or other programs as may be agreed), Users will be able to start participating in the Course according to the agreed scheduled dates and times.
9.6. If Users encounter technical issues or difficulties accessing purchased Courses, they should promptly contact our support@gettoknowthai.com for assistance and resolution.
9.7. If financial transaction fees apply to the purchase of Courses on the Platform, these fees will be collected when Users make payments via electronic cards, banking systems, or other payment methods provided by third parties on the Platform, whether for full payments or installments.
9.8 We utilize secure payment service providers to ensure the security of your payments. All financial transactions conducted through the Platform will be processed by third parties, and these transactions will be subject to their respective terms of use, privacy policies, and any relevant payment terms and conditions. We strongly recommend that you familiarize yourself with the practices of such third parties. Under no circumstances will we be held responsible for the actions or inactions of any third-party payment processor, which includes, but is not limited to, issues such as system downtime or payment service outages.
9.9 Users are responsible for all fees, taxes, and charges incurred when using the Platform. We reserve the right to change the pricing for Courses and other services at any time. Users are fully responsible for all account activity, including the payment of fees, taxes, and charges, and they must pay all fees, including taxes, incurred through electronic cards, banking systems, or other third-party payment methods on the Platform.
9.10. Users agree to take full responsibility for all use of their accounts and for any actions that take place through their accounts, including the payment of all fees and taxes incurred by anyone using their account.
9.11. Users agree and warrant that all information provided in connection with purchases, transactions, or other monetary interactions on the Platform must be accurate, complete, and up-to-date. Users are responsible for any applicable taxes related to such transactions.
10. Free Courses
10.1. We may offer free Courses on the Platform at our discretion. Users can enroll in these Courses without the need for payment or the provision of payment information.10.2. Free Courses may have a limited duration, which will be clearly indicated on the Platform. During this period, enrolled Users will have access to course materials, resources, and content.
10.3. We reserve the right to modify, discontinue, or limit access to free Courses at our discretion, without prior notice.
11. Limitation of Liability
11.1. The Site provides no warranties or representations concerning the availability of the Platform for Courses. The Platform, as well as all aspects related to access, use, or any actions related to Courses, is offered on an "as is" and "as available" basis. Users acknowledge and assume all risks associated with their interaction with the Platform. The Site makes no implied or express representations or warranties regarding the Platform, including, but not limited to, the following:(a) Suitability for commercial use and alignment with the User's specific educational objectives.
(b) Accuracy, currency, error-free nature, completeness, and reliability of any information, content, data, or materials displayed or appearing on the Platform.
(c) Uninterrupted accessibility or usage of the Platform, encompassing uninterrupted access, latency, accuracy, server stability, or the absence of errors, crashes, or defects.
(d) The absence of computer viruses, malicious code, destructive code, programs or command sequences, or any other harmful or disruptive elements within the Platform.
11.2. The Site makes no warranties and representations as to the security of any information transmitted by the User or to the User through the Platform. Users accept the risk that any information transmitted or received through the Platform may be accessed by unauthorized third parties, and/or disclosed by the Site, its officers, employees, or representatives to a third party who falsely claims to be a User or claims to have acted under the authority of the User, or inaccurately transmit by a User due to the nature of the Internet that such information may be disclosed to the public.
11.3. The Sitehas no liability for any warranty, tort, negligence, or liability arising from the Platform for the following events:
(a) Loss of profit.
(b) Loss of income.
(c) Loss of data.
(d) Loss of goodwill.
(e) Damage resulting from the use or inability to use the Platform.
11.4. In cases where the Siteis liable for the provision of the Platform to the User and/or a third party, the Site's liability shall be limited to an amount not exceeding the total value of Courses that the User has purchased from the Platform.
12. Connectivity
The Site may connect the Platform to other websites or content on the internet that are owned or operated by third parties, such as links to third-party products, websites, services, and offerings of third parties. These third-party links, products, websites, and services are not under the control of the Siteand are operated by relevant third parties. They may be protected by copyright or other intellectualproperty laws. The Sitehas no obligation to audit and is not responsible for the content, functionality, security, service, privacy policy, or other operation of these third parties. Users are encouraged to read the terms and other policies published on the website or otherwise by such third parties regarding the use of the third-party service. The User agrees that the Site will not be liable for any damage caused by the User from the use of such third-party services. The Site may terminate the use of such third-party services by the User or delete the third-party links or applications on the Platform as appropriate.
13. Participation of User
Any information, concepts, feedback, or actions that the User brings to the Platform, or forwards to the Site by any means, shall not be considered as confidential. The Sitehas the right to distribute or use the foregoing items free of charge or any liability for any purpose as required by laws, including the processing of such for the development of various programs on the Platform. The User acknowledges and agrees that the Site may develop software, applications, and other programs from such content or information. In this regard, the User agrees that the Sitehas the right to use, copy, reproduce, redistribute, transmit, modify, alter, publicize, distribute any content or information on all forms of media submitted to the Platform. This includes third-party services such as connections via Gmail, and/or other applications. This provision does not apply to personal data that is subject to the Site's privacy policy.14. Actions that may be considered illegal
In the case where there is convincing information that the User has performed or engaged in any transactions that may be fraudulent or that may be illegal, the Site may, at its sole discretion, take various measures to protect the Site, other Users, or a third party, whether it is a suspension of the Platform services, suspension of transactions on the Platform, refunds, refusals of payment, or objection to payment fees, or fines, or penalties, and any other liability. The Site may take any and/or all of the following actions:(a) The Site may terminate, suspend, or restrict access to the User account and/or suspend any transactions.
(b) The Site may suspend various benefits that the User is entitled to receive.
(c) The Site may refuse to provide services to the User, immediately.
(d) The Site may hold or withhold the User’s money for a period necessary to prevent risks that may cause liability to the Site, other Users, or third parties, or hold or withhold the User’s money in the case where there is convincing information that the User is conducting any transactions that may be fraudulent or that may be illegal.
15. Indemnification
The User shall be liable for any damage suffered by the Site due to any violation of the Terms and Conditions, and the User agrees to protect, indemnify, and defend the Site and its agents from any claim, loss, liability, or all arising from the use or access to the Site's content services or the Platform, or from the violation of the Terms and Conditions by the User, and the User must take actions for the Siteto prevent and compensate for the damage that arises.16. Severability
If this Terms and Conditions is deemed unlawful, void, or unenforceable, whether in whole or in part under the laws or by the ruling of the court, those provisions of the Terms and Conditions are deemed to be separable from the remaining Terms and Conditions and shall not affect the validity and enforceability of the remaining Terms and Conditions.17. Governing Law
The Terms and Conditions are governed by and construed in accordance with the laws of Thailand.18. Dispute Resolution
In the case that the User encounters problems in the transaction or has disputes, conflicts, or claims arising out of or in connection with the Platform, or the use of the User account (“Dispute”), such User and the Site will endeavor to settle such Dispute with eachother through friendly negotiation and in good faith. Nevertheless, if such Dispute cannot be settled within a reasonable time, the Dispute shall be resolved under the jurisdiction of the Thai courts.
19. General Terms and Conditions
19.1. The Sitehas the right to transfer/assign any rights, whether in whole or in part, as specified on this Platform, as well as any rights or obligations under the Terms and Conditions, to another person without obtaining prior consent from the User.19.2. The User shall have no right to assign or license the right to use the Platform to another person unless receiving prior written consent from the Site.
19.3. Any use of services on the Platform between the User and Site will not be considered as a joint-venture, partnership, or principal and agent relationship.
19.4. The Site's failure to enforce any of the Terms and Conditions will not be considered as a waiver of right with regard to such Terms and Conditions. The failure to enforce such right shall not in any way affect the right to which the Site can subsequently enforce the Terms and Conditions. The Sitestill retains all the right to exercise its right in any other situation where the User violated the Terms and Conditions.
19.5. The Terms and Conditions, including any policies that were specified or referred to in it, shall constitute the entire agreement, and shall supersede any prior terms and conditions or understandings between the User and the Site. The User intentionally and voluntarily engage and is bound by the Terms and Conditions. In the case that the Terms and Conditions, including any policies announced on the Platform, contradict each other, the most recent amendment of the foregoing items shall govern, and/or the Site's discretion shall be final.
19.6. Any persons or entities who are not parties to the Terms and Conditions shall have no right to enforce these Terms and Conditions in any way, regardless of whether such person or entity is identified within the Terms and Conditions or not.
19.7. The User acknowledges and agrees that any records, including any telephone conversation records (if any) relating to the Platform, are maintained by the Site, and shall be binding upon the User and/or any information that is transmitted between the Site and the User. The User agrees that all such records can be used as evidence and will not be contested or opposed on the reliability, validity, or authenticity of such records on the ground that they are in electronic form or are information obtained from a computer system.
19.8. The Site is not liable for non-performance of its obligations under the Terms and Conditions, whether in whole or in part, either directly or indirectly, caused by force majeure or any failure beyond the control of the Site.
